BACKGROUND: HB 1129 (Pigman) received final passage this morning in the Florida Senate in place of SB 1636 (Flores). This bill, passed two weeks ago by the House, received unanimous support in both chambers. The measure provides that an infant born alive during an abortion is required to be transported to the nearest emergency medical facility for immediate treatment. The bill also requires abortion providers to report infants born alive to state health officials. Failing to treat any infant born alive is a first degree misdemeanor, and known violations of the duty to treat and transport the infant must be reported to the Florida Department of Health.

HB 1129 will now go to the governor for his signature. Governor Scott has already expressed his support for the measure.
