Urge Florida House to vote ‘no’ on wage theft bill – HB 609

BACKGROUND: HB 609 (Goodson), titled “wage protection for employees”, is a poorly devised effort to solve the problem of wage theft in Florida. This bill would burden an already underfunded court system and create significant obstacles for workers seeking a basic human right – the ability to receive the just fruits for one’s labor. Not only would workers have to pay court costs and filing fees to claim their rightfully due wages, they would be denied such rights as joining a class action suit against an employer who may be withholding wages due to workers on a regular basis.

An amendment that added a proposed administrative fix lacks an appeal process so there is no incentive for employers to participate. A pending lawsuit may have some effect on what might be passed now in haste. Taking the time to create a workable solution for both employers and employees such as a conciliation process with appeals to a hearing officer and redress to the court as a last resort will save the state money.

HB 609 has passed all of its committees of reference and is scheduled to be heard by the full House tomorrow. The Senate companion, SB 862 (Simmons), remains in the Senate Judiciary Committee.
